Irwin Mitchell experienced clinical negligence team has recently helped a woman claim compensation for a cosmetic surgery that was unnecessary.
Our client suffered from a condition that caused her to develop hooded upper eyelids. As her mother’s vision had been affected by a similar condition, she decided to have cosmetic surgery to correct the problem. After the surgery she noticed some small fatty pads on her cheeks and was referred to a different surgeon who recommended a further procedure.
It was during this procedure that an excessive amount of scar tissue was removed and the cosmetic outcome was poor.
Our client’s lower eyelids were noticeably lower than they should be, her eyelashes were distorted and turned inwards, irritating her eyes and causing inflammation. Her self-confidence was affected at a time when, due to other health problems, she had hoped surgery would provide a confidence boost. She has had to undergo three further surgical procedures, with possibly more to come, as well as steroid injections to correct the damage caused by the surgery she should never have been offered.
She instructed clinical negligence specialist Louise Forsyth at Irwin Mitchell to investigate a clinical negligence claim and expert evidence confirmed that surgery carried out by the second surgeon had been performed negligently. Liability was admitted at an early stage and the claim settled for £40,000.
