S, a 42 year female, sustained injuries after she was attacked by a patient whilst working as a midwife on a post natal maternity ward. The incident occurred when S attempted to restrain a patient who had suffered a psychotic episode on the ward.
As a result of the incident, S sustained scratches to face and soft tissue injuries. She was also affected mentally and required counselling.
Following the incident, S was off work for approximately three weeks. During this period, she could not drive, had difficulties caring for her young children and relied on her partner to help her.
With the help of Mark Aldridge from Irwin Mitchell Solicitors, S brought a claim against the hospital Trust responsible for failing to ensure that the risk to staff and patients was minimised. The case was settled out of Court for the sum of £1,500.
