Our client was shopping at an Asda supermarket when she reached for a grocery item. Suddenly a sack of potatoes, which had been stored on a higher shelf, fell on her head.
Our client was understandably shocked and shaken, and called for First Aid. Although she was distressed, once her details had been recorded in the accident book, she went home.
For around 3 days following the accident, our client experienced a sharp pain at the back of her head as well as pain in her neck and so decided to go to the Hospital. She was examined and x-rayed and although, thankfully, no fracture was discovered, she was diagnosed with whiplash.
For around 3 months after the accident our client had difficulty in doing her own housework and was unable to sleep properly. For the whole of the 3 months she was also unable to go swimming, a hobby that she had previously greatly enjoyed.
Katrina Elsey, a public liability specialist, dealt with the claim. Asda admitted liability for our client’s accident and an out of court settlement of £4,000 was agreed.
