Who Is Responsible For Helicopter Accidents?

The responsibility for a helicopter accident may lie with:

  • The Pilot
  • The operating company
  • The helicopter manufacturer
  • A sub-component manufacturer.

The circumstances of the accident and parties involved will determine where we can bring your claim. For example, a claim could be made in the country where the accident occurred, the home country of the operator or the home country of the helicopter manufacturer.

As an international practice with lawyers qualified in a number of countries, we have the experience to help wherever your claim is made. Many of our lawyers are fluent in multiple languages and we have long-established working relationships with leading law firms worldwide.

We also have particular expertise bringing claims in the US, which is especially important for helicopter accident claims because many helicopters and helicopter components are manufactured in the US. Even helicopters made in Europe are often built with components from the US. As such, if your accident was caused by faulty aircraft parts or design defects, we may be able to make your claim under US law and secure a compensation settlement much higher than those awarded in other countries.

See our Manufacturing And Design Defects page for more information.

How Is Responsibility Determined?

Most helicopters do not have flight data recorders like a commercial aeroplane’s ‘black box’ so it can sometimes be difficult for the investigators…

… to find out the exact cause of the accident and determine who is responsible.

As such, understanding what went wrong and who is responsible can often rely on producing credible theories based on limited evidence. This can only be done with a detailed knowledge of both aircraft and aviation theory.

Our aviation lawyers have the expertise to succeed in these difficult cases. Our decades of experience allow us to independently analyse accidents and find evidence for the cause of the accident. We also have access to leading military and civilian helicopter pilots and engineers who can provide expert reports for use as evidence in court. Once we have ascertained the cause of an accident, we can determine who is responsible and make a claim against them.

For example, the Air Accident Investigation Branch (AAIB) was unable to identify the exact cause of a Schweizer helicopter accident in the UK. Nonetheless, our aviation team used their specialist knowledge to persuade a jury to accept a conclusion of mechanical failure rather than pilot error. The aircraft and engine manufacturers now face an American jury trial.

What Support Is Available?

However you or your family have been affected by the accident, our personal injury service ensures that all your needs are met.

It’s not just about monetary compensation. Dealing with the aftermath of a helicopter accident can be overwhelming when you suddenly have to organise things like rehabilitation, care, accommodation, transport and equipment. If it would be helpful in your case, our support and rehabilitation coordinators can assist you in access all of the care and support that you need.

We understand that even the claim itself can be a difficult process if you have been through a traumatic experience like a helicopter crash or aviation disaster. Our team is renowned for its professionalism, discretion and sensitivity during these complicated and often distressing cases.

We can also help you access support if you have suffered bereavement. Losing a loved one is always a terrible experience but the shock of an aviation disaster can make coping particularly painful. We’ve represented many bereaved families over the years and we are proud of our partnership with Cruse, the UK’s largest bereavement charity.
