Loss Of Sight Claims - More Information

The first stage is a free initial consultation where we’ll talk about your claim and decide if your injury was caused by someone else’s negligence. We’ll also discuss different ways of funding your case including No Win No Fee agreements*.

We’ll collect a variety of evidence to support your case including sending you to an independent eye specialist to examine your injuries and assess if there are risks of future deterioration. While we continue with your case we’ll make sure you have access to any medical support you may need.

Once we’ve gathered enough evidence we’ll work out how much compensation you’ll need, taking into account your pain and suffering, loss of earnings and the costs of the medical treatment you’ve had and may need in future.

Our team will present their findings to the party responsible for your injury. If they don’t accept fault or agree to pay compensation then we’ll begin court proceedings – however, the majority of cases are settled out of court.

A No Win No Fee agreement means you won’t have to pay anything upfront when you make a claim.*

If your case is successful, our legal costs will be taken from your compensation, and your opponent will pay most of your fees. If your claim isn’t successful, you won’t have to pay any costs.

Find out more about No Win No Fee claims.

The amount of compensation you receive depends on your injury and how it affects you. Compensation can help you and your family pay for any loss of earnings, further treatment and surgery, special equipment and chances of long term deterioration. It will also take into account the pain and suffering you’ve been through.

In severe cases where you’ve suffered permanent blindness, severely impaired vision or the loss of an eye we can help you secure funds for any earnings you would’ve received up until retirement age. Our team will work hard to make sure your compensation reflects the situation you’ve been left in after your injury.

Interim compensation payments are paid in advance of your final compensation. They are smaller payments, paid at an earlier stage to cover the costs of any ongoing treatments and expenses before your claim is settled.

For loss of sight injuries we’ll always try to secure an interim compensation payment to cover your immediate care needs. However, this depends on the party responsible for your injury admitting blame early on in the claim.

When your claim settles and your final compensation is paid, any interim compensation payments will be taken off the amount you receive.

With offices across the UK, we’re consistently ranked among the very best serious injury lawyers in the country by independent legal guides who say we're "incredibly knowledgeable, with the resources to make sure claimants are put in the best possible position" (Legal 500, 2021). We’ve also won Post Magazine’s Rehabilitation Award on seven different occasions and have close relationships with charities such as Sight Concern and Beacon 4 Blind.

Frequently Asked Questions

Can My Compensation Pay For Any Cosmetic Surgery?

Yes, if you’ve suffered an eye injury and you’re unhappy with the cosmetic appearance of your damaged eye we could arrange for a cosmetic prosthesis (an artificial eye) or a cosmetic shell (similar to a contact lens) to be made.

A damaged eye can also lose shape over time, your compensation can cover any corrective eyelid surgery you may need in future.

Our team of serious injury solicitors will take all your needs into account to make sure your compensation is fair and covers any immediate and future support you or a loved one may need.

Will I have To Attend A Medical Appointment?

As part of the claims process we’ll arrange for an independent eye specialist to examine your injuries. They’ll give a long term prognosis and see if there are risks of future deterioration.

They’ll also tell us if you can return to or gain employment (or return to education for a child) and if you’ll have a similar lifestyle to the one before your injury.

This information will help our solicitors determine the right amount of compensation for you which will make sure all your needs are taken care of.

How Can Irwin Mitchell Help?

Independent legal guides recognise us as one of the best personal injury law firms in the country and we'll do everything possible to help you get the compensation you deserve. Your solicitor will keep you fully informed of everything that’s happening throughout your claim.

In certain circumstances, we can try to get you an early payment from your compensation so that you can pay your bills (if you can’t work, for example) or to pay for private treatment to help you recover as quickly as possible. We’re also experienced in taking on complex claims and will often take on cases that have been turned away by other solicitors.

Our commitment goes beyond financial compensation, making sure that you get the best available care, from medical treatment to rehabilitation and other specialist support.

As a full-service law firm we can also provide a number of specialist support services which may be able to help with your circumstances. We have experts in areas including:

  • Wills – We can help you make a Will in order to protect your family in the future and can help with handling the affairs of a loved one who has passed away.
  • Court of Protection – Our Court of Protection lawyers could provide you with advice on managing someone else’s affairs if they are unable to, and help in disputes relating to social care and medical treatment. The team can also help set up personal injury trusts which can mean that your compensation award isn’t considered when you’re assessed for certain means-tested benefits.
  • Employment – We can provide specialist advice on issues that may arise such as sick pay and your ability to complete your role.
  • Asset Management – This team can help plan how your compensation could be invested to ensure that funds are available throughout your life.
  • Rehabilitation – Our support and rehabilitation coordinators can help you access the rehabilitation services and support you need in order to make the best recovery possible.

To find out more about how we can help with your loss of sight claim, contact us online or call us on 0800 056 4110.
